Welcome to ExpressNaturally ("us," "we," or "our"). These Terms of Service ("Terms") govern your use of our website and the AI-powered language learning tools provided (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Description of Service

ExpressNaturally provides a suite of AI-powered tools, including WriteNaturally, ToneNaturally, PairNaturally, and ReadAloudly, designed to help users improve their English communication skills. The tools process user-provided text to offer suggestions, translations, and learning materials.

2. User Responsibilities

You agree to use the Service in compliance with all applicable local, state, national, and international laws, rules, and regulations. You are solely responsible for the text and content you input into the Service ("User Content"). You agree not to use the Service to:

  • Upload, post, or transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • Upload, post, or transmit any User Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships;
  • Interfere with or disrupt the Service or servers or networks connected to the Service.

3. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of ExpressNaturally and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

You retain all rights in, and are solely responsible for, the User Content you submit to the Service. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display such User Content solely for the purpose of providing and improving the Service.

4. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. ExpressNaturally disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance.

ExpressNaturally does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

5. Limitation of Liability

In no event shall ExpressNaturally, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (iiii) any conduct or content of any third party on the Service; (iiii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

6. Rate Limiting and Service Availability

Certain features of the Service, such as ReadAloudly, may be subject to usage limits (e.g., a certain number of generations per IP address per day). These limits are in place to ensure fair usage and service availability for all users. We reserve the right to modify these limits at any time. We are not liable for any inability to access features due to these limits.

7. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
